Yes; the smart non-smoker has precedence. Why? Because through no fault of his own he will be placed in danger by others. It's like saying that a citizen knocked down by a car shouldn't be on the road. This is not the case; there are many reasons for being on roads and the laws of the United Kingdom recognise this. Hell in America cars have to stop in some states if a person walks out on to the road.
As for all this democracy stuff; certain things are healthy, certain things aren't. I fully agree with the right of the adult to choose but I suffer no man to choose to harm me just because I'd like a drink with my friends in the convivial atmosphere of a public house. If people want to smoke in their own homes, I could care less.

But people don't only smoke in their home, I have nothing against to go to a desinated place to smoke, but make it human.

Consider the designated places as they exist currently. In work places which have such designated areas, the smell still lingers in the corridors nearby and therefore pollutes the air of the general populace. In work places which don't have designated areas, staff go outdoors (unless it is raining) and pollute the air of people on a public walkway.

Tax gas and cars out the arse, and subsidize bicycles for everyone! That's what I say. The world got along just fine and dandy before everyone decided that they had to be in a rush to get everywhere.

For the past couple of years I have been very actively campaigning at my workplace for improved ventilation on the shop floor to reduce the dust, acid fumes and all the other airborn nasties that float about.
The company's reponse?.
We are considering a site wide no smoking policy.
The reason: It's much cheaper to stick up a few No Smoking signs than it is to introduce proper ventilation.
Then again steel dust and hydrochloric acid fumes are harmless compared to a cigarette, obviously.
Doncha just love the capitalist ba****ds

It truly is a shame that such is the nature of most humans. Unfortunately, greed is the ruling force in the universe, and there's really not much we can do about it...
That sounds a little Nietzschean of me. We are not without hope, but the general public must come to a better understanding of the nature of the human before we can overcome such greed...if it's possible.

The "pollution" caused by the smoke emanating from cigarettes on the walkway is almost non-existant. We would have to fine people farting on the walkway if we go down that road

Very true. I think people over-exaggerate the pollution of cigarettes, even when considering second hand smoke. Ever walked down Broadway in NYC? You get more toxins in you lungs there from car pollution than you would by standing next to someone smoking a a stogie.
That puts us on the subject of banning cars...but that's for another thread.
